1. Our Role as Technology Provider Hyatt Creative Design (“we,” “us,” or “our”) provides 3D architectural visualization and lead-capture infrastructure for the building, design, and real estate industries. We do not engage in direct marketing, sales calls, or consumer outreach. Our role is limited to creating and deploying the digital twin/virtual tour system and securely capturing lead data on behalf of our clients (Builders, Developers, Designers, and Real Estate Agents).
2: Information Collection & Purpose
To grant access to certain "Pre-Market" virtual tours, we collect:
Identification Data: Name, email address, and telephone number.
Compliance Records: A digital audit trail of your express choice regarding marketing contact by the specific Builder or Agent identified on the access form.
Operational & Analytics Data: We collect information regarding tour access and interaction. This data is used for internal analytics (to help Builders understand project interest) and security purposes (to monitor and protect against unauthorized access or misuse of our proprietary 3D environments).
3. Data Distribution Information collected through this system is delivered directly to the Project Owner (the Builder, Developer, or Listing Agent). Once delivered, the Project Owner is the "Data Controller" and is solely responsible for how they use, store, and protect that information in accordance with their own privacy practices.
4. No Facilitation of Communication Hyatt Creative Design does not facilitate, mediate, or participate in any subsequent communication between you and the Builder or Agent. Any marketing calls, SMS/text messages, or emails you receive are initiated solely by the Project Owner or their designated sales team.
5: Data Retention & Disposal
We practice "Data Minimization." We maintain your information only for the duration of the specific real estate project or as required to fulfill our analytical and security obligations.
Automatic Disposal: Upon the conclusion of the project or the decommissioning of the virtual tour from our servers, all associated data in our possession is permanently deleted.
6: Your Consent & TCPA Compliance
By submitting your information and selecting the consent option, you provide "Express Written Consent" under the Telephone Consumer Protection Act (TCPA) for the Builder/Agent to contact you. If you choose to view the tour without providing marketing consent, your data is still collected for the security and analytical purposes outlined in Section 2. Hyatt Creative Design maintains the record of these selections to protect the legal integrity of the sales process.
7. Security We use industry-standard encryption to ensure your data is moved securely from the tour gate to the project lead log.
8. Your Rights & Data Deletion
You have the right to know what personal data we have collected and to request its correction or deletion.
Request Deletion: If you would like your information removed from the Project Owner’s active lead list and our secure temporary storage, please email HyattCreativeDesign@gmail.com with the subject line "Data Deletion Request."
Processing Time: We will process all deletion requests within 30 days and confirm when your data has been permanently scrubbed from our infrastructure.
Third-Party Deletion: Since Hyatt Creative Design provides the data to the Project Owner (Builder/Agent), we will also notify them of your request so they can update their records accordingly.
